ARTICLE 3 – APPLICABILITY
These Terms & Conditions apply to every offer made by the entrepreneur and to every agreement concluded between the entrepreneur and the consumer.
Before concluding a distance agreement, these Terms & Conditions will be made available electronically to the consumer.
ARTICLE 4 – THE OFFER
All offers are non-binding and subject to availability.
The entrepreneur reserves the right to modify or adjust offers, pricing, and product information at any time.
Product descriptions and images are presented as accurately as possible. Minor variations in colour, appearance, or packaging may occur depending on device settings or production batches.
Obvious mistakes or errors in pricing or product descriptions are not binding.
ARTICLE 5 – THE AGREEMENT
The agreement becomes effective once the consumer accepts the offer and completes the checkout process.
After an order is placed, the consumer will receive an electronic confirmation of the order.
The entrepreneur reserves the right to refuse or cancel orders in cases including but not limited to suspected fraud, unauthorized transactions, or incorrect pricing.
ARTICLE 6 – RIGHT OF WITHDRAWAL
Consumers have the right to withdraw from their purchase within the applicable return or cooling-off period provided under these Terms and any mandatory consumer law that applies to their purchase.
To exercise the right of withdrawal, the consumer must notify the entrepreneur in writing via email.
ARTICLE 7 – RETURNS & REFUNDS
Return shipping costs are the responsibility of the consumer unless otherwise agreed or required by applicable consumer law.
Refunds will be processed after the returned item has been received and inspected, or after valid proof of return has been provided where applicable.
Returned items must be unused, unworn, and returned in their original condition and packaging where reasonably possible.

ARTICLE 8 – EXCLUSION OF THE RIGHT OF WITHDRAWAL
The right of withdrawal may be excluded for products:
- made to the consumer’s specifications;
- clearly personalized;
- sealed products not suitable for return due to hygiene reasons once opened;
to the extent permitted by applicable law.
ARTICLE 9 – PRICES
All prices displayed on the website are listed in the applicable currency.
Taxes, customs duties, import charges, or other government-imposed fees may apply depending on the destination, value of the shipment, and applicable law.
Where we are legally required to collect GST, VAT, or another applicable tax at checkout, this will be handled in accordance with the applicable tax rules.
ARTICLE 10 – CONFORMITY & WARRANTY
The entrepreneur guarantees that products reasonably conform to the agreement and product description.
Customers should contact us as soon as reasonably possible if a product is defective, damaged, or incorrectly delivered.
Nothing in these Terms limits any statutory consumer guarantees or other rights that cannot legally be excluded.
ARTICLE 11 – DELIVERY & EXECUTION
The entrepreneur will process and ship accepted orders within a reasonable timeframe.
Estimated delivery times are indicative only and may vary depending on destination country, customs processing, carrier operations, and other circumstances outside our reasonable control.
The entrepreneur is not liable for delays caused by customs authorities, carriers, force majeure events, or circumstances beyond reasonable control, except where liability cannot legally be excluded.
ARTICLE 12 – PAYMENT
Payment must be completed through the payment methods offered during checkout.
Orders will only be processed after successful payment authorization.
ARTICLE 13 – COMPLAINTS
Complaints regarding products or services must be submitted in writing via email within a reasonable timeframe after discovery of the issue.
The entrepreneur aims to respond to complaints within 7 business days.

To the maximum extent permitted by law, the entrepreneur shall not be liable for indirect, incidental, or consequential damages arising from the use of products or services purchased through this website.

However, consumers retain any mandatory consumer protections that apply to them under the laws of their country or region of residence, including applicable Australian consumer protections.

ARTICLE 17 – ERRORS, INACCURACIES & OMISSIONS
Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping times, or availability.
We reserve the right to correct any errors and to update information at any time without prior notice.
ARTICLE 18 – INTERNATIONAL SHIPPING, DDU, GST & IMPORT DUTIES
Orders may be shipped from international fulfilment facilities depending on product availability and the customer’s delivery destination.
Unless expressly stated otherwise at checkout, international shipments may be sent on a Delivered Duty Unpaid (DDU) basis or equivalent arrangement. This means that any customs duties, import taxes, clearance charges, handling fees, or similar charges imposed upon importation that have not already been collected by us at checkout are the responsibility of the customer.
For orders shipped to Australia, Australian Goods and Services Tax (GST) may apply.
Where Hamilton Island Boutique is required by Australian law to collect GST at the point of sale, the applicable GST may be included in or added to the amount charged at checkout.
Where GST, customs duties, import taxes, or other charges are not collected by Hamilton Island Boutique at checkout and are subsequently imposed by customs authorities, carriers, or other government agencies, those charges are the responsibility of the customer to the extent permitted by applicable law.
Customers are responsible for ensuring that any applicable import charges are paid in order for their shipment to be released by customs.
Refusal to pay applicable customs charges or failure to accept delivery does not automatically entitle the customer to a full refund. Any refund in such circumstances will be subject to our Returns & Refunds Policy and applicable consumer law.
For most goods imported into Australia with a value of AUD 1,000 or less, there are generally no duties, taxes or charges collected at the border, but GST can still apply at the point of sale.
